Terms of service

1. The agreement

These terms apply between CellierBook and the business holding an account ("the venue"). Creating an account means accepting them.

2. The service

CellierBook is a hosted reservation service, provided as it is at the time of use. Features may be added, changed or removed.

3. Accounts

The venue is responsible for its account credentials, for everything done through the account, for the accuracy of the information it enters, and for how it uses the reservation information its guests provide.

4. Subscription, billing and cancellation

One plan, billed monthly or annually at the price shown at the time of subscription. Prices may change on notice; a change does not affect a period already paid for.

A trial period of fifteen days is offered. No payment method is required to begin. At the end of the trial, new reservations stop unless a subscription is taken. Existing reservation records remain visible to the venue.

A subscription may be cancelled at any time. Access continues to the end of the period already paid for. Amounts already paid are not refunded.

If payment fails or a subscription lapses, new reservations stop. Existing reservation records remain visible to the venue.

5. Availability

No particular level of availability is guaranteed. Interruptions, errors, delays and downtime can occur, including from the third-party services this product depends on and during maintenance. Where a fault is within CellierBook's control, work will be undertaken to correct it. Email delivery depends on providers and receiving servers outside CellierBook's control and cannot be guaranteed.

Nothing in this section is a commitment to a repair time.

6. Acceptable use

The service may not be used unlawfully, to send unsolicited messages, to attempt to access another venue's data, or in a way that interferes with its operation for others.

7. Intellectual property and information

The service, its software, its design and its name are owned by CellierBook.

Information entered by a venue belongs to the venue's account and remains available to it. CellierBook processes that information to operate, maintain and improve the service.

Handling of personal information is described in the Privacy Policy.

8. Limitation of liability

To the extent permitted by law:

The service is provided without warranties of any kind, express or implied, including any implied warranty of fitness for a particular purpose.

CellierBook is not liable for indirect, incidental or consequential loss, including lost bookings, lost revenue, lost profits, lost data, or harm to reputation.

Total liability arising from the service, for any and all claims, is limited to the amount paid in the twelve months preceding the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited by law.

9. Suspension and termination

An account may be closed by the venue at any time. CellierBook may suspend or close an account for non-payment, for breach of these terms, or where required by law. On closure, reservation data will be made available to the venue for a reasonable period before deletion.

10. Changes to these terms

These terms may change. Material changes will be notified to account holders. Continued use after a change means accepting it.

11. Governing law

These terms are governed by the laws of Québec and the laws of Canada applicable there.
